My wife and I were visiting Tucson to spend time with friends and to see the sights when I fell as a result of a broken fence in a public area. The resulting injuries were life threatening, causing a disruption to our vacation and several years of medical care to manage pain. A Satisfied Client
Effective legal representation in a personal injury/wrongful death case involves several key elements. A good attorney must have a reputation for being willing to take a case to trial and for being effective in a courtroom. He or she must also construct a strategy that is strong on all of the key elements of the case. In the case in which David Dwyer represented my family, the crucial elements were: (1) establish the legal certainty that the defendant's liability insurance did in fact cover the incident in question; (2) establish that the incident was the cause of death for the victim, though the death occurred three months later; (3) determine a reasonable estimate of damages; and (4) create the conditions necessary for a favorable settlement.
Mr. Dwyer would almost certainly have prevailed on the first listed element on his own, but to expedite the process and add certainty, he associated in another attorney who had been the first to defeat the problematic provision in the insurance contract, and together they were able to very quickly get the insurance company to acknowledge that the incident was indeed covered. On the second element, Mr. Dwyer located a highly credible medical expert who did an excellent analysis of the victim's medical history that was accepted without challenge by the insurance company after its experts' review. On the fourth element, after it became clear that the insurance company did not initially 'value' the damages within the likely range identified by Mr. Dwyer, Mr. Dwyer arranged mediation proceedings with a highly respected mediator and the attorney for the defendant. The mediator independently determined a likely value in the upper half of the range identified by Mr. Dwyer (thereby validating his work on the third element above). At the completion of the second mediation meeting, the insurer had accepted a settlement very close to the mediator's valuation and within the upper half of the range initially identified by Mr. Dwyer.
I recommend Mr. Dwyer to any potential client with a valid personal injury or wrongful death claim.
