In 2018 I was attacked by a vicious dog who had gotten out of its yard and was running freely in the alley behind its house. During the attack I fell and broke my knee cap into two places. Needless to say, I needed orthopedic surgery followed by physical therapy to walk again. I did not see which yard the dog came from but, fortunately, a man walking nearby heard my screaming and came to my aid, scaring off the dog. He saw the dog go back into a yard through an open gate. I mailed a certified letter to the dog’s owner detailing her dog’s behavior and my injuries but got no response from her. After I reported the attack to Pima County Animal Control, a case worker interviewed her and she denied owning the dog. I called some widely-advertised personal injury attorney’s offices in Tucson and was directed to staff members; all said that I did have a case against the dog’s owner and they were eager to sign me up. I got the impression that the firms operated like factories and I doubted I would get the best representation.
I then looked up offices that had a smaller number of attorneys, that is how I found Dave Dwyer. I spoke directly with Dave, he listened to how the attack occurred and immediately had an action plan: 1) use a private investigator to contact the witness and meet him at the owner’s gate to make sure it was the gate the dog went through and get a signed statement. 2) he would write a letter to the dog owner informing her about my injuries and recommend that she contact her home insurance carrier and file a personal liability claim. 3) if she ignored the letter we would file a lawsuit and, if necessary, the PI would track her down and serve her a court order. She did ignore the letter, we filed a lawsuit, and it was sent to her by mail. She also ignored the mailed lawsuit documents so the PI served her a summons at her workplace. This got her attention and her home insurance carrier shortly afterwards contacted Dave.
Dave negotiated with her insurer to get me the maximum compensation dictated by the limits of her policy. The hospital I went to for emergency care and surgery placed a lien on the settlement even though my health insurance covered their contracted amount of the bill (the hospital charged me their “full price” which was 66% more than the insurance paid. Yes, that is legal in AZ!) After Dave negotiated with the hospital they substantially lowered the lien amount. I am very grateful to Dave for his work to get me compensation for my injuries, I recommend his law firm without hesitation.

After I crashed my bicycle on an incomplete chip seal project, I was referred to Dave by another attorney due to his expertise in this area. On a short timeline, Dave was able to get a road engineer to examine the crash site and agree that I had a legitimate case against the city. Partway through the course of the lawsuit, Mr. Dwyer made arrangements for a mediation between our family and the defense attorneys. While it was not successful, the mediation process was enlightening. Also, we felt that the mediator was professional and unbiased. We appreciated the efforts by Mr. Dwyer to maintain professional but cordial relations with the various defense attorneys. Some of those attorneys were already acquaintances of Mr. Dwyer, and others were not, but there was an adversarial but not an unduly antagonistic relationship in those interactions. I think that contributed to Mr. Dwyer’s ability to ultimately resolve to the family’s satisfaction the lawsuit without having to go to court. Finally, I greatly appreciated that Mr. Dwyer was meticulous in documenting the expenses involved in the course of the lawsuit. His records were very complete, and it was obvious he was not into overcharging for travel expenses incurred in the course of deposing the expert witnesses. He made sure that my mother’s insurance company and Medicare did not overcharge for expenses, and that there would not be any liens against the estate when the final settlement was reached.

Effective legal representation in a personal injury/wrongful death case involves several key elements. A good attorney must have a reputation for being willing to take a case to trial and for being effective in a courtroom. He or she must also construct a strategy that is strong on all of the key elements of the case. In the case in which David Dwyer represented my family, the crucial elements were: (1) establish the legal certainty that the defendant's liability insurance did in fact cover the incident in question; (2) establish that the incident was the cause of death for the victim, though the death occurred three months later; (3) determine a reasonable estimate of damages; and (4) create the conditions necessary for a favorable settlement.
Mr. Dwyer would almost certainly have prevailed on the first listed element on his own, but to expedite the process and add certainty, he associated in another attorney who had been the first to defeat the problematic provision in the insurance contract, and together they were able to very quickly get the insurance company to acknowledge that the incident was indeed covered. On the second element, Mr. Dwyer located a highly credible medical expert who did an excellent analysis of the victim's medical history that was accepted without challenge by the insurance company after its experts' review. On the fourth element, after it became clear that the insurance company did not initially 'value' the damages within the likely range identified by Mr. Dwyer, Mr. Dwyer arranged mediation proceedings with a highly respected mediator and the attorney for the defendant. The mediator independently determined a likely value in the upper half of the range identified by Mr. Dwyer (thereby validating his work on the third element above). At the completion of the second mediation meeting, the insurer had accepted a settlement very close to the mediator's valuation and within the upper half of the range initially identified by Mr. Dwyer.
I recommend Mr. Dwyer to any potential client with a valid personal injury or wrongful death claim.
